MP lambasts Judiciary for "reviving Ba'ath"

Shafaq News/ The Rapporteur of the Parliamentary Committee for Martyrs and Political Prisoners pilloried the court decree annulling the decision of the Accountability and Justice Commission, warning of the revival of the Ba'ath party.

In a statement issued earlier today, Saturday, Committee Rapporteur, MP Khalaf Abdul-Samad Khalaf, lamented the Court's decision, "we do not know why did not the court respect the constitutional and statutory provisions, neither the goals nor the reasons for the legislation of the Accountability and Justice Commission law no.10 of 2008 stipulating whoever had committed crimes against the Iraqi people or appropriated public funds from those who belonged to the Ba'ath Party, partisan ranks, and repressive apparatuses."

"These decrees attempt to restore a group to the political life or other fields. This oppressing group has participated in repressing the Iraqi people and committed heinous crimes."

"Despite our utmost respect for the Judiciary and the principle of the separation of authorities, our constitutional, legal, humanitarian, and Jurisprudential duty obliges us to refuse any decisions that aim to bring Ba'athists back to authority under any nomenclature."

"The 7th Article of the Iraqi constitution is a constitutional proof that all the Ba'athists, whatever their rank was, are under legal accountability. Selective decisions could not be made by selecting some provisions and ignoring others... Law is a unit."

The Rapporteur of the Parliamentary Committee for Martyrs and Political Prisoners called on the Judicial authority to review its decree and consider in the following decrees the constitutional and legal provisions and transitional justice laws, particularly the Accountability and Justice law no.10 of 2008.
